Online Real Estate Bids: A 3% online buyer’s premium will be added to winning bid price to create total purchase price. Auction is set to close at the advertised date and time.  Any bid placed within the last two minutes of any individual tract's ending time will extend the remaining bidding time back to two minutes remaining on all individual tracts, and the clock will begin to count down again.  Any bid on any individual tract extends the bidding time on ALL INDIVIDUAL TRACTS back up to two minutes. This will continue until two minutes have passed with no bids being placed on any individual tract, and the time remaining has expired. 

All individual tracts are subject to property being offered as a whole after individual tract bidding has concluded.

Property As A Whole: To tie property as a whole, the bid for the whole property as one tract must exceed the combined total of the individual Tracts 1-3 by $10,000.00

Note:  In the event of a technical error, Phillips Brothers Auctions may, if deemed necessary, extend the bidding on individual tracts or property as a whole.

ONLINE Auction Terms - Real Estate: A 10% non-refundable earnest money escrow deposit is due to Phillips Brothers Auctions at signing of purchase contract (and/or signing via electronic signature) on Wednesday, May 27th, 2026 by 4:00 p.m., with the balance due on or within 30 days at closing. A 3% Online Buyer's Premium will be added to the high bid to create total contract price. At closing, Seller will pay for deed(s), current existing survey, and a preliminary title search that has already been performed. Title insurance is available at the expense of the purchaser. Property taxes will be prorated to the date of closing. All other closing costs are to be paid by the purchaser. Property sold by deed description as recorded and by existing boundaries. Use of waterfront areas is understood by all parties to be subject to the discretion and permission of TVA and BCDA rules & regulations. Possession given at closing. All property sold AS-IS with no contingencies.  Any inspections to the property may be done prior to auction ending at purchaser's expense.  Auction is for the deed to the property as it is legally described, assessed, and recorded in Franklin County, Alabama, less any existing road right-of-ways or easements. Title to property will transfer by deed description as described. Any measurements or dimensions described or advertised are to be considered to be to the best of our knowledge but should be confirmed by purchaser. It is the buyer's responsibility to inspect prior to bidding to determine if property, dimensions, condition, permissible use, added value of structures, and layout are suitable.  Property sold subject to sellers’ confirmation of acceptable final bid price. Seller reserves the right to accept or reject any offer. All seller confirmed sales are final with no contingencies. Phillips Brothers Auctions is agent for seller in this transaction and will assist the purchaser as a transaction facilitator in closing on the property.

Preliminary Auction Plat: Property is being offered in 3 tracts by a preliminary auction survey that has been reviewed and is within the scope of permissible property divisions allowed by Franklin County. Plat is not a final survey. If property is sold in more than one tract, the seller will have the auction plat finalized including a signature by the licensed surveyor and the Franklin County engineer, and then recorded with the county. This is not a subdivision, and no restrictions are attached to the property.
